1. Purpose & Scope
These Retailer Delivery Staff Code & Access Terms (“Terms”) govern the conduct, responsibilities and platform access of individuals (“Delivery Staff”) who use the Nowx platform to perform delivery, installation, demonstration or in-home trial services.
Acceptance of these Terms is mandatory for platform access.
Nowx provides only the technology platform enabling assignments and does not supervise, direct or control the activities of Delivery Staff.
2. No Employment or Agency Relationship
a.Delivery Staff acknowledge that they are not employees, agents or representatives of Nowx.
b.Delivery Staff are engaged by and act on behalf of the Retailer.
c.Nothing herein creates any employment, partnership or agency relationship between Delivery Staff and Nowx.
Nowx does not control work hours, compensation, discipline or employment conditions.
The Retailer remains fully responsible for the conduct, supervision and actions of Delivery Staff performing assignments through the Platform.
3. Eligibility & Access Conditions
Delivery Staff must:
a.Be legally eligible to work
b.Provide accurate identity information
c.Complete platform verification requirements
d.Use the platform only for authorised assignments
Access is permission-based, revocable at any time.
4. Professional Conduct Standards
Delivery Staff shall:
a.Behave professionally and respectfully at all times
b.Follow customer instructions and platform protocols
c.Respect customer privacy, property and personal space
d.Comply with all safety and trial guidelines
e.Carry only authorised products into customer premises
5. Prohibited Conduct
Delivery Staff shall not:
a.Enter customer premises without verification or consent
b.Exceed authorised trial duration
c.Record customers outside platform-enabled systems
d.Engage in harassment, coercion, misrepresentation or abuse
e.Consume alcohol or prohibited substances during assignments
f.Commit theft, fraud or unsafe acts
g.Share customer data or platform information
Any violation may result in immediate access termination.
6. In-Home Trial & Safety Obligations
Where assignments involve in-home trials:
a.Delivery Staff shall follow time, handling and safety rules
b.Products shall not be altered, substituted or misused
c.Any incident, injury or complaint must be reported immediately
Safety takes precedence over completion.
7. Data, Privacy & Recordings
a.Delivery Staff acknowledge that platform activity may be logged and recorded.
b.Such data may be used for safety, compliance and dispute resolution.
c.Delivery Staff shall not object to admissibility of platform records.
8. Order Status Updates & Authenticity
8.1 Mandatory Status Flow
Delivery Staff shall update order status accurately and sequentially using the Platform, including but not limited to:
a.Order Packed (where applicable)
b.On the Way
c.Arrived at Customer Location
d.Trial Started (if applicable)
e.Trial Completed / Order Delivered / Order Returned
Status updates shall reflect actual real-world actions, not estimates or assumptions.
8.2 Authentication & Verification
a.All order status updates shall be made only through the Delivery Staff’s authenticated platform account.
b.Each status update may be subject to OTP verification, geo-location validation, timestamp logging or other authentication mechanisms.
c.Delivery Staff shall not share login credentials, devices or access with any other individual.
Any update made through a Delivery Staff account shall be deemed to be made by that Delivery Staff.
8.3 Accuracy & Evidentiary Value
a.Delivery Staff acknowledge that order status updates form part of the official transaction record.
b.Platform-generated logs, timestamps and location data relating to status updates shall be deemed accurate and binding unless conclusively proven otherwise.
c.Delivery Staff waive any objection to the admissibility of such records on the basis of electronic form.
8.4 Prohibited Manipulation
Delivery Staff shall not:
a.Falsely mark an order as delivered, arrived or completed
b.Update status without physically performing the corresponding action
c.Manipulate, delay or bypass required verification steps
d.Attempt to alter or reverse status logs outside the Platform
Any such act shall be treated as misconduct and misuse of the Platform.
8.5 Consequences of Misuse
Misuse or false status updates may result in:
a.Immediate suspension or permanent revocation of platform access
b.Blocking from future assignments
c.Reporting to the Retailer
d.Cooperation with law enforcement or regulators, where required
Such actions may be taken without prior notice.
8.6 Survival
Obligations relating to order status accuracy, authenticity and evidentiary value shall survive suspension or termination of access.
9. Access Control & Suspension
Nowx may, at its sole discretion:
a.Suspend or revoke Delivery Staff access
b.Block specific assignments or accounts
c.Cooperate with law enforcement or regulators
No notice or reason is required.
10. Indemnity
Delivery Staff shall be responsible for their own actions and omissions and shall indemnify Nowx against losses arising from misconduct, unlawful acts or breach of these Terms.
11. Acknowledgement & Acceptance
By accessing or using the Nowx platform, Delivery Staff confirm that they:
a.Have read and understood these Terms
b.Agree to comply fully
c.Accept that access is conditional and revocable
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of India.
